These Terms of Service (“Terms”) govern your use of the WildStash mobile application (“App”, “Service”) operated by Slawomir Szostak (“Provider”, “we”, “us”), an individual developer based in Poland.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description
WildStash is a community-driven mobile application for mapping wild plants — including fruits, herbs, bushes, fruit trees, and mushrooms — found in publicly accessible locations. The Service allows users to:
- Browse an interactive map of community-contributed plant spots
- Add spots with species identification, photos, and descriptions
- Control spot visibility using three levels: public, group, or private
- Create and join groups to share spots with trusted people
- Browse a species database with multilingual names and descriptions
- Confirm spots added by other users
3. IMPORTANT: Edibility and Safety Disclaimer
WARNING — PLEASE READ CAREFULLY
WildStash provides community-contributed data only. It does NOT provide professional botanical, nutritional, medical, or safety advice.
- Species identification may be incorrect. Users are not verified botanists. Any plant identification within the Service may contain errors.
- WildStash does NOT guarantee the accuracy of any information, including but not limited to edibility, toxicity, allergenicity, medicinal properties, or safety of any plant or mushroom listed in the Service.
- Some wild plants and mushrooms can cause serious illness or death. Never consume anything you cannot identify with absolute certainty.
- You assume ALL responsibility for any foraging, consumption, or other decisions you make based on information found in the Service.
- Always consult a qualified professional (botanist, mycologist, physician, or other expert) before consuming, touching, or otherwise using any wild plant or mushroom.
- The Provider is not liable for any harm, illness, injury, allergic reaction, poisoning, or death resulting from the use of information found in the Service.
By using WildStash, you acknowledge and accept this disclaimer in full.
4. Account Registration
4.1. To use features beyond browsing public spots, you must create an account by providing a valid email address and password.
4.2. You must be at least 16 years of age to create an account. If you are under 16, you may not use the Service.
4.3. Each person may maintain only one account. Creating multiple accounts may result in termination of all associated accounts.
4.4. You are responsible for maintaining the security of your account credentials. You must not share your password with others.
4.5. You must provide accurate information during registration and keep it up to date.
5. Permitted Use
The Service is intended for:
- Personal, non-commercial mapping and discovery of wild plants in publicly accessible locations
- Sharing knowledge about wild plant species and their locations with the community or selected groups
- Educational purposes related to botany, foraging, and nature
6. Prohibited Use
You agree not to use the Service to:
6.1. Post false or misleading content — including fake spots, intentionally incorrect species identifications, or fabricated descriptions.
6.2. Map private property — spots must only mark plants in publicly accessible locations. Do not add spots on private land without the landowner’s explicit permission.
6.3. Harass, threaten, or abuse other users in any way.
6.4. Spam — including mass-creating low-quality spots, promotional content, or irrelevant material.
6.5. Scrape, crawl, or automatically extract data from the Service by any means not explicitly authorized by the Provider.
6.6. Use the Service for commercial purposes — including selling access to spot data, using the Service to promote commercial products, or reselling Service data.
6.7. Circumvent security measures — including attempting to access other users’ private or group spots, bypassing rate limits, or reverse-engineering the Service.
6.8. Violate any applicable law — including local foraging regulations, trespassing laws, or environmental protection rules.
6.9. Upload content that is illegal, offensive, or unrelated to the purpose of the Service.
7. Content and Intellectual Property
7.1. Your content. You retain all ownership rights to the content you create and upload to the Service, including photos, descriptions, and spot data.
7.2. License to WildStash. By posting content to the Service, you grant WildStash a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content within the Service for the purpose of operating and providing the Service. This license exists for as long as your content remains on the Service.
7.3. Public spots. Content associated with public spots may be visible to all users of the Service, including unauthenticated guests. By setting a spot to public visibility, you acknowledge that this content will be accessible to anyone.
7.4. Content removal. You may delete your content at any time. Upon deletion, we will remove the content from active display within a reasonable timeframe, though cached copies may persist temporarily.
8. Content Moderation
8.1. The Provider reserves the right to review, edit, or remove any content that:
- Violates these Terms
- Marks locations on private property
- Contains incorrect species identification that could pose a safety risk
- Is offensive, inappropriate, or unrelated to the purpose of the Service
- Is reported by other users and found to be in violation
8.2. Content moderation decisions are made at the Provider’s discretion. Users may be notified of content removal but are not guaranteed an appeal process.
9. User Responsibilities
9.1. Accuracy. You should make reasonable efforts to provide accurate information when adding spots, including correct species identification and location.
9.2. Legal foraging. You are solely responsible for complying with all local, regional, and national laws regarding foraging, plant collection, and access to land. WildStash does not verify the legality of foraging at any location.
9.3. Respect for nature. You agree to practice responsible foraging — do not over-harvest, damage plants, or disturb ecosystems. Leave enough for wildlife and regeneration.
9.4. Respect for others. Treat other community members with respect. Do not share others’ private or group spots without their consent.
10. Limitation of Liability
10.1. The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
10.2. The Provider does not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Any information in the Service (including species data, edibility information, or spot locations) is accurate, complete, or current
- The Service will meet your specific requirements
10.3. To the maximum extent permitted by applicable law, the Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Service
- Any foraging, consumption, or other activity based on information found in the Service
- Any errors or inaccuracies in species identification, edibility data, or other content
- Unauthorized access to or alteration of your data
- Any other matter relating to the Service
10.4. If, despite the above limitations, the Provider is found liable, the total liability shall not exceed the amount you have paid to the Provider in the 12 months preceding the claim, or EUR 50, whichever is greater.
11. Account Termination
11.1. By you. You may delete your account at any time through the App settings or by contacting [email protected]. Upon deletion, your account data will be removed in accordance with our Privacy Policy.
11.2. By the Provider. We reserve the right to suspend or terminate your account, without prior notice, if you:
- Violate these Terms
- Use the Service in a manner that could harm other users or the Service itself
- Create multiple accounts
- Engage in any prohibited use described in Section 6
11.3. Upon termination, your right to use the Service ceases immediately. Content you have posted may be retained or deleted at the Provider’s discretion, except where removal is required by law.
12. Data Protection and Privacy
Your privacy matters to us. The collection, processing, and protection of your personal data is governed by our separate Privacy Policy. By using the Service, you also agree to the terms of the Privacy Policy.
13. Changes to These Terms
13.1. The Provider may update these Terms from time to time. Changes will be communicated through an in-app notification.
13.2. The updated Terms will specify the new effective date.
13.3. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and delete your account.
14. Governing Law and Jurisdiction
14.1. These Terms are governed by and construed in accordance with the laws of the Republic of Poland.
14.2. Any disputes arising from or related to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Wroclaw, Poland.
14.3. If you are a consumer residing in the European Union, you also have the right to submit a dispute to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
